Campaigen Terms and Conditions / Privacy Policy

CAMPAIGEN TERMS and CONDITIONS

Before applying to the "Sony x World Aquatics Instagram #Hashtag Campaign" (hereinafter referred to as "this Campaign") hosted by Sony Corporation (hereinafter referred to as "the Company"), please read the following Campaign Terms and Conditions (hereinafter referred to as "these Terms") carefully and confirm their contents in advance. By applying to this Campaign, customers (hereinafter referred to as "Participants") are deemed to have agreed to these Terms and Conditions. Please note that Meta Platforms, Inc., which operates Instagram, is not involved in this Campaign in any way, including sponsorship, endorsement, operation, or any other form of involvement. Meta Platforms, Inc. and Instagram shall be completely released from all responsibility by each Participant in this Campaign.

  1. This Campaign is open to anyone who has an Instagram account and has reached the age of majority in their country or region at the time of application. For minors at the time of application, consent from a parent, guardian, or legal guardian is required for participation.
  2. To enter this Campaign, you must complete the following steps
    • Follow the @sonycorporation.global Instagram account.
    • Choose one of the two themes and post a photo or video that aligns with that theme on your Instagram account. When posting, include the hashtag for your chosen theme, along with all three designated hashtags in the caption

  3. To participate in this Campaign, your Instagram account must be set to public.
  4. It is prohibited to tag or submit photos or videos submitted to this Campaign (hereinafter referred to as "Submission Entries") and their related comments/hashtags that contain defamatory, libelous, obscene, sexual, profane, threatening, or illegal materials, or materials that may be considered criminal, give rise to civil liability, or otherwise constitute or encourage acts that violate the law or Instagram's Terms of Use.
  5. The Company will select photos or videos at its discretion from among the Submission Entries that meet the criteria set forth in these Terms and Conditions, based on which entries best align with the purpose of this Campaign. The submitters of the selected Winning Submission Entries (hereinafter referred to as "Winners") will be contacted via direct message from the @sonycorporation.global Instagram account, and are requested to send their personal information (name, address, telephone number) to the Company's email address as instructed.
  6. Prizes will be sent to winners from the Sony distributor in their region of residence. Personal information (name, address, telephone number) will be handled according to the policies of the Sony distributor in the winner's region of residence.
  7. In applying to this Campaign, Participants warrant the following
    • That the Submission Entry fully complies with these Terms and Conditions and Instagram's Terms of Use
    • That the Participant has all rights (including copyright) necessary to grant the Company a license to use the Submission Entry in accordance with these Terms and Conditions
    • That the Submission Entry does not infringe upon any third party rights (portrait rights, privacy, or other personal rights)
    • When music, images, videos, audio, photographs, text, or other materials are included in the Submission Entry, appropriate licenses, permissions, or waivers have been obtained from the rights holders. Participants acknowledge that they are prohibited from posting photos or videos sourced from third-party sources (including other websites or blogs), and that unauthorized use of such photos or videos may constitute copyright infringement.
  8. After the Company has sent the prize, if the Winning Entry is reasonably determined to violate these Terms and Conditions or be contrary to public order and morals, the Company may request the winner to return the prize.
  9. Winners grant the Company an irrevocable, non-exclusive, royalty-free license to copy, modify, edit, revise, publish, reproduce, display, distribute, and otherwise use the Winning Entries across all media operated by Sony Group Corporation, the Company, and their subsidiaries (hereinafter "Sony Group Companies") (including the right to sublicense to other Sony Group Companies). In particular, Winners acknowledge and agree that the Winning Entries may be published on Sony Group Companies' media, and that the Company may edit or modify the Winning Entries (including trimming and adding images, music, sound effects, etc.). For other uses of the Winning Entries, the Company will obtain the Winners' acknowledgment and consent. Winners warrant that they have the necessary rights to grant the license set forth in this section. Winners agree to waive all moral rights of authors regarding the use of the Winning Entries against Sony Group Companies.
  10. The Company shall not be liable for any responsibility regarding Participants' publication and use of Submission Entries in connection with their application to this Campaign, and if disputes arise with third parties regarding such matters, Participants shall resolve them at their own responsibility and expense. Participants agree to indemnify and hold harmless the Company, Sony Group Companies, directors, employees, and agents from any claims, damages, losses, costs, and expenses arising in connection with their application to this Campaign, including the Company's use of Submission Entries and Participants' approval thereof.
  11. We make no representations or warranties, express or implied, with respect to this Campaign other than those set forth in these Terms and Conditions. We are not responsible for any technical errors or errors on the Instagram platform that prevent you from entering this campaign or sending or receiving direct messages. However, we do not seek to exclude liability for death or personal injury caused by our own negligence.
  12. The Company's failure to exercise any provision of these Terms and Conditions shall not be deemed a waiver of such provision.
  13. Unless otherwise provided by local law in the country or region of residence of the applicant, this Campaign and these Terms and Conditions shall be governed by Japanese law. All disputes relating to this Campaign shall be subject to the jurisdiction of the Tokyo District Court as the court of first instance.

PRIVACY POLICY FOR Instagram CAMPAIGN

This Privacy Policy applies to Instagram Campaign (the "Campaign"). This Privacy Policy explains our collection, use, sharing and other practices regarding your data when you participate in the Campaign.
In this Privacy Policy, we use “SONY,” "we," "us," and "our" to refer to Sony Corporation. “SONY Affiliates” shall mean Sony Group Corporation, which is the ultimate parent company of SONY and any legal entities controlled by Sony Group Corporation. The term “control” in this context means the direct or indirect ownership of more than fifty percent (50%) of the voting interest in such corporation or the power in fact to control the management decisions of such entity.

  1. What information does SONY collect?
    We collect and use information or data as described below, some of which may be considered personal information under applicable law in your jurisdiction, and it is collected when you choose to provide information to us or automatically when you are participating in the Campaign (collectively, the “Collected Data”). To the extent permitted by law, we may create statistical data or other information that cannot be used to identify individual customers, and such information is not covered by this Privacy Policy.

  2. How does SONY use the Collected Data?
    SONY uses the Collected Data for the following purposes:
    • Selecting prize winners
    • Communicating to the prize winners
    For EEA/UK Individuals: Please note that the legal basis under for this processing is the performance of the contract that we have with you.
  3. Who else has access to the Collected Data?
    The Collected Data may be made available to SONY Affiliates and to other third parties as well as those you choose to share the Collected Data with, as follows:
    1. (i) SONY Affiliates
      The Collected Data may be shared with and used by SONY Affiliates to pursue the activities related to the purposes set out in this Privacy Policy.
    2. (ii) Service providers
      SONY and SONY Affiliates may use third party service providers to process the Collected Data on our behalf for the purposes set out in this Privacy Policy. Such third parties include IT service providers and data hosting providers.
    3. (iii) Business transfer
      In the event that SONY or SONY Affiliates sell or transfer a portion or all of its business, the Collected Data may be transferred by SONY or such SONY Affiliates to the purchasing or acquiring entity as part of the transaction, including any due diligence process connected to the sale or transfer.
    4. (iv) Government Authorities/ Law Enforcement Officials
      The Collected Data may be disclosed to government authorities and/or law enforcement officials if required by the applicable laws.
    5. (v) Other Unaffiliated Third Parties
      We may disclose the Collected Data to auditors or similar external consultants like lawyers or tax advisors, to defend and exercise our legal rights (e.g., enforcing compliance with the terms of use) and as we believe necessary to comply with our legal obligations.  SONY may disclose any of the Collected Data if required or permitted by law, regulation or order, or if we believe in good faith that disclosure is reasonably necessary for us to protect or enforce the rights, property, safety or security of ourselves or others, to third parties including government authorities and law enforcement officials, and auditors and similar external consultants like lawyers and tax advisors.
  4. Data Retention
    SONY will keep the Collected Data for as long as it is necessary for the relationship with you and the purposes detailed in Section 2 or otherwise permitted or required under applicable law.

    SONY may retain the Collected Data for an appropriate period to protect ourselves from legal claims, to administer our business, or to the extent permitted by applicable law, which may require us to hold the relevant Collected Data for specific periods.
  5. Transfer of the Collected Data internationally and Consent to processing
    The Collected Data may be processed, stored and transferred to countries/regions outside your country/region of residence, including in particular Japan. By participating in the Campaign, or providing us with any information, you fully understand and consent to this transfer, processing and storage of your information in Japan and other jurisdictions, where the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

    For EEA/UK Individuals:
    Sony takes appropriate measures to ensure that all transfers of Collected Data to outside of the EEA/the UK and Switzerland meet the requirements of applicable EU and UK data protection legislation. As the Collected Data will be transferred to and processed in countries outside the EEA, Switzerland and the UK, where the privacy laws may not provide an equivalent level of protection to those in your home country, and where this is to a stakeholder or vendor in a country that is not subject to an adequacy decision by the European Commission or the UK Government, the Collected Data is adequately protected by Standard Contractual Clauses approved by the European Commission which can be accessed here, the addendum to the EU Commission’s standard contractual clauses or standalone international data transfer agreement approved under the UK data protection law (as applicable) or a stakeholder’s/vendor’s Processor Binding Corporate Rules.   6. Security
    SONY undertakes reasonable security measures designed to protect against the loss, misuse or alteration of the Collected Data. Although SONY strives to protect the Collected Data, SONY cannot guarantee or warrant the security of any Collected Data transmitted to SONY through the Campaign or that SONY stores on its systems or that is stored on SONY’s third party contractors' systems.
  7. Policy Regarding Children
    The Campaign does not target users under the age of 13 and if you are a minor under the applicable laws of your country/region of residence, you must obtain permission from your parent or legal guardian to participate in the Campaign. If we become aware that we have collected personal information from a minor without such consent, we will delete that personal information from our files promptly.
    If you are a parent or guardian and are concerned that your child has provided SONY with personal information (as defined by applicable law), you should contact us as indicated below.
  8. Changes/Policy Governs Use
    SONY reserves the right to make changes to this Privacy Policy and will notify you of any changes by prominently posting notice of the amendment on or within the Campaign. We may also provide notice to you in other ways, such as through contact information you have provided. You are advised to consult the posted Privacy Policy regularly for any changes.
    Your continued participating in the Campaign after the posted effective date will constitute acceptance of, and agreement to be bound by those changes to the extent allowed by law.
  9. Your Privacy Rights/Jurisdiction Specific Notices:
    In some jurisdictions, you have certain rights with respect to the Collected Data that SONY holds about you. These may include the right to request access to the Collected Data and/or you may request that SONY corrects, amends, deletes, erases, destroys, blocks/restrict processing and/or use of such Collected Data. You may also object to SONY’s processing of Collected Data. These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping. If you would like to exercise any rights available to you, please contact us as described in “Section 10. Contact Us”.

    (i) Notice to Residents of U.S. States (including but not limited to: VA, CO, CT, MT, IA, DE, UT, TN, TX and OR; but excluding California)
    We set forth in our Privacy Policy, Table 1 the categories of personal data we process, the purpose for processing personal data, the categories of personal data shared, and the categories of third parties with whom personal data is shared.
    Consumers in certain states with comprehensive privacy laws may have the following rights:
    • Right to Know and Access. The right to confirm whether we are processing personal data about you and to access such data. Residents in certain states may also obtain a list of third parties with whom we have shared personal data.
    • Right to Correct. The right to correct inaccurate Personal Data we hold about you.
    • Right to Delete. The right to delete the Personal Data provided by you or obtained about you.
    • Right to Data Portability: The right to obtain a copy of the Personal Data previously collected by us and, to the extent feasible, in a readily usable format to allow data portability.
    • Right to Appeal. If for any reason you would like to appeal a decision made by us relating to your request to exercise privacy rights, you have the right to submit an appeal to us. Please include your full name, the basis for your appeal, and any additional information to consider.

While some state laws may permit you to opt-out of the automated decision making and profiling in furtherance of decisions that produce legal or similarly significant effects, we do not engage in either of these activities at this time.

      This California Privacy Notice is effective as of June 11, 2025.
      This California Privacy Notice supplements our Privacy Policy and sets forth the disclosures and rights for California Consumers regarding their personal information, as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and any implementing regulations adopted thereunder (“CPRA”). Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CPRA, unless otherwise defined

      California Consumer Rights.Subject to certain exceptions, as a California consumer, you may have the following rights regarding your Personal Information:
    • Right to Know. Request information regarding what Personal Information we collect, use, disclose, and sell, including the right to request that we provide you with the categories and /or specific pieces of Personal Information we have collected about you.
    • Right to Delete. Request deletion of the Personal Information we collect about you.
    • Right to Correct. Request correction of inaccurate Personal Information that we maintain about you.
    • “Do Not Sell or Share My Personal Information.” While you may have the right to opt-out of the “sale” of your Personal Information or the “sharing” of your Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising), SONY does not sell or use data from the Campaign to engage in such practices at this time and thus does not provide these rights.
    • Limit the Use and Disclosure of Sensitive Personal Information.” Under the CPRA, a business must provide the Right to Limit the Use and Disclosure of Sensitive Personal Information when Sensitive Personal Information is collected or processed for the purpose of inferring characteristics about a consumer or does not fall under certain statutory exceptions. SONY does not use or disclose Sensitive Personal Information in connection with the Campaign SONY’s use and disclosure of Sensitive Personal Information is not used for such purposes and/or falls within the statutory exceptions, and we therefore do not offer this right at this time.

Agents. If you are an authorized representative submitting a request on a consumer’s behalf, please complete the applicable request per the instructions below. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and a clear description of the permission granted. Alternatively, you may submit a copy of a power of attorney under applicable state law. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit the request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

Verifying Requests. In your request, you must provide enough information to allow us to verify you are the person about whom we collected Personal Information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate and respond to it. We will only use the information you provide in a request to verify your identity. When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we may ask that you provide us with additional information in order to verify your identity and fulfill your request. If we are unable to verify your identity, we will not be able to process the request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights.
California Consumers have the right to not receive discriminatory treatment for exercising CPRA rights. We will not discriminate against you for exercising your CPRA rights.

Notice of Financial Incentive.
Under California regulations, if we offer certain loyalty or similar program(s) directly or reasonably related to the collection, retention or deletion of your Personal Information, such program may be considered a “financial incentive”. In such case, we will be required to make additional disclosures to you, which we will provide when you agree to participate.

Personal Information We Collect & Purposes for Collection.
The Personal Information we collect about you will depend upon how you are participating in the Campaign. Accordingly, we may not collect all of the below information about you. In addition to the below, we may collect and/or use additional types of information and will do so after providing notice to you and obtaining your consent to the extent such notice and consent is required by applicable law. We may have used Personal Information for the business or commercial purposes described in Table 1:

If you are a California resident, under the California “Shine the Light” law, you have the right to receive: a) information identifying any third party company(ies) to which we may have disclosed, within the past year, personal information pertaining to you and your family for that company's direct marketing purposes; and b) a description of the categories of personal information disclosed. To obtain such information, please email your request to SonyElectronicsPrivacy@sony.com, and include your name, email address, mailing address or zip code, and a reference to “Your California Privacy Rights – Instagram Campaign.” We are not responsible for requests that are not labeled or sent properly, or do not have complete information.

(iii) Notice to Nevada Residents
If you are a Nevada resident, you have the right to opt-out of the sale of certain personally identifiable information we have collected about you to third parties. SONY does not currently sell your personally identifiable information as those terms are defined under Nevada law. However, if you wish to submit a request to opt-out of the sale of such information if Sony were to engage in such a sale in the future, you may submit your request in writing to: SonyElectronicsPrivacy@sony.com. Your request must reference “Your Nevada Rights – Instagram Campaign” and include your name, mailing address, zip code, and email address. We are not responsible for requests that do not come through the designated request mechanism or do not contain sufficient information to allow us to process your request. We will respond to valid requests within 60 days.

(iv) Further Information for Residents in Québec, Canada
This notice sets forth disclosures and rights for consumers residing in Québec, Canada regarding their personal information, as required by the Québec’s Data Privacy Law 25. All Sony personnel handling personal information will be subject to a duty of confidentiality and to ensure that all personal information is handled in accordance with standard security measures. By participating in the Campaign, you acknowledge and agree that your personal information will be transferred outside of Quebec.
We will only use your personal information for the purposes stated at the point of collection, or as otherwise noted in this privacy policy.

Automated Decision Making. SONY does not use personal information to render any decisions based exclusively on an automated processing of such information.

Location Tracking.
We may use automated technologies to collect information about your general location, such as your country. However, we do not track your location without your consent.

Consumer Rights.
Subject to certain exceptions, you may have the following rights regarding your personal information:

  • Right to Inform/Access. Request to confirm the existence of the personal information, communicate it to you, and allow you to obtain a copy of it.
  • Right to Erasure. Request that we remove information we have collected from you.
  • Right to Rectify. Request rectification of inaccurate personal information we maintain about you
  • Right to Withdraw/Restrict Processing. Request to withdraw previously provided consent to process your personal information.

You may also ask us to clarify the categories of persons that have access to your personal information and the applicable retention period.
